LAW ENFORCEMENT USE OF ARTIFICIAL INTELLIGENCE (AI)

PURPOSE

The purpose of this informational newsletter is to inform Department personnel of changes to California law regarding Law Enforcement’s use of artificial intelligence (AI) that will take effect January 1, 2026. 

All personnel considering the use of AI must ensure compliance with California law in this area. 

BACKGROUND

Senate Bill 524 (2025) was approved by the Governor on October 10, 2025, and is codified at California Penal Code section 13663.  The following is a summary of the new law.  Department personnel should review the new law in its entirety.

Effective January 1, 2026, California Penal Code section 13663 requires an official report prepared by a law enforcement officer or any member of a law enforcement agency that is generated using artificial intelligence (AI), either fully or partially, to include a specified disclosure statement and the author’s signature.  The code also requires the retention of specific records, including early drafts and audit trails, when AI is used to generate an official report.

SPECIFICS OF CALIFORNIA PENAL CODE SECTION 13663: ARTIFICIAL INTELLIGENCE

Definition:

The code defines AI as follows:

“Artificial intelligence” means an engineered or machine-based system that varies in its level of autonomy and that can, for explicit or implicit objectives, infer from the input it receives how to generate outputs that can influence physical or virtual environments. 

“Artificial intelligence” as used in this section applies to artificial intelligence systems that automatically draft police report narratives based upon an analysis of in-car or dash-mounted cameras, or body-worn camera audio or video, and artificial intelligence systems that analyze a law enforcement officer’s dictated report to generate a police report narrative automatically enhanced by generative artificial intelligence.

Application:

The new law significantly impacts the manner in which department employees are permitted to write reports with the assistance of AI.  Department members are reminded that they are responsible for the contents of any official report they generate.  (MPP 3-01/005.10 – Responsibility for Documentation.) 

According to California Penal Code section 13663, if AI is used - fully or partially - to prepare an official report by a law enforcement officer or any member of a law enforcement agency, the law enforcement agency is responsible for:

  • Clearly identifying every AI program used in the official report.

  • Prominently stating on each page of the report:

“This report was written either fully or in part using artificial intelligence.”

  • Including the author’s physical or electronic signature attesting that they have reviewed and verified the contents and accuracy of the report.

  • Retaining the first AI-generated draft of the report for the same duration as the official report.

  • Recognizing that any AI-generated draft (other than the final signed report) cannot be considered an officer’s statement.

  • Maintaining an audit trail identifying:

    • The person who used AI to create the draft or report.

    • Any audio/video footage used by the AI (e.g., BWC, dash cam).

California Penal Code section 13663 also mandates that:

  • AI vendors cannot share, sell, or use agency-provided information for any purpose other than the agency’s needs or a court order.

  • Vendors may access data only for technical reasons (e.g., troubleshooting, bias mitigation, accuracy improvements).

CONCLUSION

An addition to the Manuals of Policy and Procedure (MPP) and/or a Field Operations Directive (FOD) is expected to follow.
