A claim for priority is established:

  1. If not disputed by the parties to the action within five days after receiving a copy of the claim (CCP 1206(c))   or
  2. After the order allowing the claim becomes final.  (CCP 1206(e); Driver v. International Air Race, 54 CA 2d 614)  Unless appeal is waived, the order does not become final until expiration of the time to appeal or final judgment on appeal.
