5-02/040.05 - Advisement of Constitutional Rights



All juveniles arrested under sections 601 and 602 of the Welfare and Institutions Code (WIC) shall be advised of their rights in accordance with sections 625 and 625.6 WIC, even if there is no need to interrogate the juvenile.

Prior to a custodial interrogation and before accepting a waiver of any Miranda rights from a juvenile who is 15 years of age or younger, sworn personnel shall adhere to section 5-07/010.05.

Deputy personnel shall ensure that arrested juveniles completely understand their constitutional rights.

Deputy personnel shall comply with section 5-07/010.15, prior to initiating a field interrogation.
