See section 5-06/080.00. Immediately evacuate and secure the area. Give particular attention to fire safety and possible noxious gases/vapors. Deputies shall not handle dangerous chemicals, materials or waste. District Attorney Environmental Crimes Unit may provide assistance as needed. If traffic accident related, see section 4-06/047.00. Code as applicable: 511 - Illegal Dumping of Hazardous Materials. Pursuant to Section 25180.7, California Health and Safety Code, any information regarding illegal or threatening discharge of hazardous waste that is likely to cause substantial injury to the public health or safety shall be reported to the Board of Supervisors and Department of Health Services within 72 hours. Knowing and intentional failure to report an illegal or threatening discharge is punishable as a felony. NOTE: Reporting of such information is not required when otherwise prohibited by law, or when law enforcement personnel have determined that such disclosure would adversely affect an ongoing investigation or when the information is already public knowledge within the locality affected by the discharge or threatening discharge. Deputy personnel shall prepare an SH-R-49 for each reported incident. District Attorney personnel shall evaluate and investigate each reported incident to determine if it meets the criteria for disclosure to appropriate agencies. All reports shall be processed with priority and forwarded immediately to the District Attorney Environmental Crimes Unit, who is responsible for making the appropriate notifications within the statutory 72-hour time limit. |
